Terms and Conditions for Performers of
Clarence Tunes Festival 2023

Clarence Tunes is a small-scale, one-stage music festival, featuring local up-and-coming musicians from the Clarence Valley area and surrounds. The festival will be held on the 25th March 2023, at Maclean Showground Oval. The event is produced, organised and promoted by Crofton Productions, and is in its second year of running.

 

Food trucks will be at the event selling street food, thanks to Maclean Football Club, Curry Pockets and Flour + Water Woodfired Pizza. All performing musicians will receive a food/beverage rider consisting of bottled water and a free meal from Maclean Football Club’s pop-up stall. All musicians will also receive an Identification (ID) badge to validate your special privileges at the festival.

 

What we require from you before we can confirm your slot:

- Group Contact

  • The Clarence Tune 2023 Performance Agreement (Pg 3) is to be signed and returned.

  • Join the CT 2023 Musos WhatsApp group chat (QR Code below). This chat will be updated regularly with important information regarding Clarence Tunes 2023.

- Each Individual Member of the Performance

  • The Clarence Tunes - Performer Photo/Video Release Waiver form (Pg 4) is to be signed and returned (note that this must be completed by a parent or legal guardian if the member is aged under 18).

  • Must confirm their availability for the entirety of Saturday 25th March 2023.

  • Join the CT 2023 WhatsApp group if they wish to do so.

Please note the following performance requirements when preparing:

  • No chord/lyric sheets, scores or sheet music are permitted on stage unless otherwise approved by Crofton Productions.

  • All music played in the performance is to be performed live, and not played from a pre-recorded track, unless otherwise approved by Crofton Productions.

  • Performance time slots will range from 10 minutes to 25 minutes, this will be specified in your confirmation email.

Please familiarise yourself with the Clarence Tunes Performance Payment process as stated below:

  • Each performance slot at Clarence Tunes will be paid a guarantee of $200 plus a confidential percentage of total profits (as specified in the Performance Agreement).

  • Upon completion of performances, a notice will be sent out to each performer's group contact, detailing the necessary invoice total.

  • An invoice must then be created and sent to Crofton Productions for payment.

  • Payment may take between 3 and 7 days from transaction initiation. 

 

Invoice Requirements:

  • The invoice must be addressed to “Crofton Productions”. ABN - 77219430229. Address - Parcel Collect 10269 27223 44 River Street, Maclean, NSW, 2463, Australia. Phone - 0457959930. Email - nash@croftonproductions.com.au.

  • Supplier details must include a name, phone number, email address and a physical billing address.

  • It must include payment details for EFT. Including the account holders name, BSB and ACC number.

  • Must include two lines of items. Line 1 - “Clarence Tunes Performance Guarantee - Performer Name” for $200. Line 2 - “Clarence Tunes Performance Additional Payment - Performer Name” for the relevant amount.

  • The invoice must quote a valid ABN. If not possible, the invoice may be sent without an ABN, as long as it is completed with a valid Statement By A Supplier form (see attached).

  • The invoice must also include the invoice number, issue date and due date. Note that the due date must be no shorter than two weeks from the 25th March 2023 (≥ 08/04/2022)

Clarence Tunes performer Terms and Conditions are as follows:

1. The band/artist will be paid by electronic funds transfer within 7 days, on presentation of a valid invoice and Statement By A Supplier form where required.
2. The presenters must be notified of any cancellation of performance more than 21 days prior to the event.
3. The event organisers will supply publicity material to the musicians suitable for promotional purposes.
4. The artist/band and those people connected with the artist/band will at all times conduct themselves in a manner acceptable to the venue, organisers and other participants in the event.
5. That the artist/band and those people connected with the artist/band will follow the organiser/venue manager's instructions regarding security, safety, emergency procedures, police liaison and crowd control measures.
6. The venue/organiser agrees to hold and have in place all required and relevant APRA licences.
7. The band/artist agrees to abide by all of Clarence Tunes’ Terms and Conditions as outlined at https://www.clarencetunes.com.au/tcs.
8. As the band/artist contact, I understand that it is my responsibility to keep all band members and affiliates informed with updates.

9. I hereby grant Crofton Productions or any of its affiliates permission to use photographs, videos or any other visual media representation of the performer at their sole discretion. I understand that this may include - but is not limited to - promotional and branding material.

10. I hereby affirm that such release to the releasee does not constitute any form of compensation, including royalties arising from the photographs, to my benefit.

11. I understand and agree that photographs in the possession of the releasee shall become the property of the releasee. The use and publication of the photographs however, shall conform to my rights as a subject of said photographs.

12. I hereby waive my right to inspect or approve the photographs by which my likeness appears.

13. I hereby hold harmless, release, and forever discharge from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

14. I understand that failure to complete this waiver is likely to result in termination of performance at Clarence Tunes 2023.
