Thank you for your interest in Clarence Tunes . Before you proceed to purchase tickets, we strongly recommend that you go through the following terms and conditions:

These Terms and Conditions were last updated 5th October 2022.

 

In this section, words like ‘holder’, ‘bearer’, and ‘purchaser’ will refer to you – the person who will buy the tickets to Clarence Tunes. On the other hand, ‘our’, ‘us’, ‘we’, ‘issuer’, ‘provider’ and similar terms will indicate the organiser of Clarence Tunes – Crofton Productions.

 

By opting to purchase, allocate or possess tickets to Clarence Tunes, you automatically agree to our terms of use. If you have problems with any of the clauses listed below or do not agree with the risk allocations mentioned here, please do not purchase tickets or try to enter the Clarence Tunes premises.

 

• Please note that Crofton Productions reserves the right to make changes, revisions, and amendments, or add/remove sections from this set of terms and conditions – without any prior notifications to you. Such changes will be duly reflected on the website of the organiser https://www.clarencetunes.com.au. These changes will relate back to the date of purchase of Clarence Tunes tickets.

 

• The price of one Clarence Tunes General Admission, purchased minimum one day in advance to Clarence Tunes is $12 plus processing fees of $0.30 and booking fees of $0.50 (AUD) unless purchased from the box office in which the rate is $12 (AUD). This figure is non-negotiable. 

 

• The price of one Clarence Tunes U/12 ticket is free (AUD). This figure is non-negotiable.

 

• The price of one Clarence Tunes General Admission, purchased on the day of Clarence Tunes is $15 (AUD). This figure is non-negotiable. 

 

• Tickets may not be available on the night if for any reason it is deemed N/A. Applicable reasons may include but are not limited to, a full venue (1000 for Maclean Show Ground & 240 for our backup venue, Maclean Bowling Club), lack of staff to run door or lack of facilities to provide door tickets.

 

• Clarence Tunes is an alcohol and drug free event. If any alcohol or illicit drugs are found in your possession, you will be asked to leave the premises of Clarence Tunes. This may change depending on the venue of Clarence Tunes although you will be notified if so.

 

• The ticket you purchase represents a revocable license for you to access Maclean Showground on 25/03/2023, when Clarence Tunes is scheduled to be hosted. The license includes the revocable right to attend Clarence Tunes. This license can be revoked at any time by the issuer at its sole discretion, without any prior notifications or compensation options. If the license is revoked, you will not be granted entry at the venue.

 

• Security personnel as well as any employee or volunteer of Clarence Tunes may refuse entry or evict you or any of your invitees if they are behaving in an intoxicated, disorderly, offensive, threatening or inappropriate manner, towards any person. Security personnel have the power powers to: 

1. ask for your ID to determine your age;

2. refuse entry or ask you to leave.

3. Use a ‘reasonable degree of force’ to eject you from the premises or to control a situation; and  

4. perform a citizen’s arrest and detain you until police come, if you are committing a crime or have just committed a crime.

 

• Crofton Productions authorised volunteers, employees or security personnel may be identified by any of the following:

1. Clarence Tunes Badge containing their employee/volunteer ID.

2. Orange or yellow Hi-vis Vest containing the phrase 'Duty Officer' on the back.

 

• The bearer has to assume full responsibility of the Clarence Tunes tickets, once (s)he receives it. Clarence Tunes have no liabilities – financial, legal, or otherwise – in case the tickets are stolen, lost, damaged, destroyed or rendered unusable in any other way.

 

• TryBooking is the sole authorised source for purchasing Clarence Tunes tickets. If you obtain your ticket(s) from any other unauthorised source, you take on the risks of those tickets turning out to be counterfeit or reported to be stolen. The issuer has the right to dishonour such stolen/counterfeit tickets and declare them as void.

 

• The Clarence Tunes tickets delivered to you are not meant to be used for illegal reselling, copying, reproducing, or misrepresenting in any form. You cannot use the ticket(s) for any promotional/advertising purposes either (including sweepstakes and competitions) without our prior approval. Any proven record of such activities will result in immediate seizure and cancellation of your ticket(s).

 

• Please note that Clarence Tunes tickets cannot be redeemed against cash, credits, or any other benefits unless deemed acceptable by event organiser.

 

• Crofton Productions has the right to investigate if there has been any violation of the Clarence Tunes ticketing terms and conditions. In case of any conflicts, the decision of Crofton Productions will be deemed final (i.e., the issuer will remain the final arbiter in cases of disputes).

 

• The event service will be deemed to have been delivered in its entirety as soon as Clarence Tunes starts on 25/03/2023. From that point on, no refund requests will be entertained.

 

• If you are not able to access any particular section(s) of the venue – Maclean Showground – due to delays, federal/state/council regulations, organiser policies, weather-related problems, emergencies, venue shutdown/evacuation or any other reason, you will be granted a refund or future credit upon your request.

 

• If Clarence Tunes is cancelled in its entirety due to any unforeseen circumstances, Clarence Tunes have the sole and absolute right to:

i) reschedule the event, or

ii) issue a partial/full refund, or

iii) provide a comparable ‘make good’ option.

 

• Please note that the decision of the issuer in such cases will be deemed final and binding.

 

• If Clarence Tunes is cancelled due to any factors or causes not in the control of the issuer, the latter will offer a partial or full refund, or postpone the event, or provide a comparable ‘make good’ option. These factors will be inclusive of, but not limited to, natural disasters, federal/state/council announcements, strikes, delays in production, outbreak of the COVID-19 disease and the like. Once again, the decision of Crofton Productions will be considered final in accordance with the Australian Consumers Act.

 

• If Clarence Tunes has to be rescheduled to other dates, you will be eligible for a refund upon your request. In case the event is fully cancelled, the refund, if issued, will include ONLY the face value/printed value of the ticket(s). The bearer cannot, under any circumstances, claim refunds on shipping fees, processing fees, handling fees, and such other charges.

 

• Losses, if any, occurring due to foreign exchange fluctuations at the time of refunds, have to be borne by the purchaser. Crofton Productions cannot be, in any way, held liable for that.

 

• All ticket sales are deemed as FINAL TRANSACTIONS. There will be no ticket returns/exchanges/cancellations unless provided by Crofton Productions sales team.

 

• At the time of entering the event venue, you are required to produce the ticket and a valid identification document (ID). By presenting an ID, you confirm that all details present on it are accurate and updated.

 

• By purchasing Clarence Tunes tickets and presenting the same at the venue, you give your consent to Crofton Productions to collect certain information about yourself (name, picture, date of birth, gender, address, etc.) for verification and storage.

 

• You hereby agree to forego all types of surcharge claims – full or in part – and all claims & entitlements related to it.

 

• Crofton Productions does not take any responsibility to personal/financial damages caused to you at the venue, or for any items lost/stolen/misplaced at the venue. Financial reimbursement claims on these counts will not be entertained.

 

• Clarence Tunes and Crofton Productions follow a common ‘zero-tolerance policy’ towards unauthorised drug usage or carrying at the venue, AND towards any type of behaviour/actions that can be interpreted as lewd or obscene. If you are found in possession of prohibited items at Clarence Tunes and/or if you indulge in any objectionable action, your participation in the event will be terminated immediately. Your event ticket(s) will become void from that point on.

 

• By purchasing or using a ticket for entry to Clarence Tunes, you give your permission for photos, video or other media content to be taken, containing you in it, to be used for social media (Facebook, Instagram etc.) advertisements etc. If you have an issue with this term, please contact us at hello@clarencetunes.com.au.

 

• Please note that you purchase Clarence Tunes tickets on your own free will. As such, you do not have the right to initiate a chargeback claim or dispute on the provider of the credit card/debit card that had been used for the transaction. Further refund/return/cancellation requests will not be entertained either.

 

• In all cases of disputes between the ticket-bearer and the ticket-issuer, the decision of the latter will be deemed final. In case a dispute cannot be resolved, the help of an independent third-party arbiter will be sought.

 

• Crofton Productions, employees of Crofton Productions, volunteers of Crofton Productions and any security personnel employed by Crofton Productions have the right to remove any persons from the Maclean Showground at their discretion if they feel that you are behaving in an inappropriate or dangerous manner.

 

• We reserve the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements and audience capacity without any notice. Such changes will be updated throughout our website, booking page and social medias within 2 days of change.

 

• We reserve the right at any time, to change the venue of the Event. In the event of a change in venue, we will publish details on the Clarence Tunes website and socials.

 

• Any videos, photographs or other media content posted to any social media platform including but not limited to Instagram, Facebook or Twitter must mention Clarence Tunes through a mention (@clarencetunes) or a hashtag (#clarencetunes).

 

• The concert may feature some strobe lighting effects which may affect customers susceptible to photosensitive epilepsy or other photo sensitivities. Crofton Productions can not be liable for any harm or inconveniences caused as a result of the show lighting or sound system.

 

• In the case that the venue of Clarence Tunes is to be changed, no refunds will be issued to ticker holders so long as the new venue is within 20 kilometres of the original. All details regarding these Terms & Conditions as well as any details of the original site will then be applicable to the new venue.

 

PRIVACY

• In order to purchase your ticket, we may need to collect and keep personal information about you including your name, address, payment details, telephone number and the names of all ticket allocations. We may also need to disclose your personal information as required by law or as permitted under the Privacy Act. Your information will not be disclosed to any third party organisations unless permission is granted by the owner.

 

• All attendees consent to be included in photographic, film and other visual and audio recordings of the Event and grant the promoter the right to use such photos and recordings for promotion, marketing and other purposes in all media without restriction.

 

FINAL TERMS

• Crofton Productions may, without prior written notice, invalidate any tickets that are believed to be in breach of these terms and conditions, and no refund, replacement or compensation will be offered.
